We think its safe to say that the recent crop of XBL bans have come about by M$ collecting your eeprom data including your HDD serial number / key when you sign up to Xbox Live for the first time - this is what's known as the "Marriage Theory".
So basically if you upgrade your hard drive after signing up to XBL your account will get fried. We feel there is no "drive scanning" taking place so dont be paranoid about where you are storing your files.

Solution?: Upgrade your hard drive BEFORE signing up to the XBL service.
Better Solution?: Hacking the firmware of the upgraded hard drive to have the same serial number / key as your stock hard drive. We will have a play - as I'm sure others will.

la mejor solucion pues como creo que dice modificar el firmware del disco duro para tener el mismo nº de serie del original.......uh,
lo que no he encontrado es como hacerlo [enfa] .

te seria mas facil cambir el disco antes de conectarte al live por primera vez
es igual si tengo el disco duro original con el evox?
De momento, que se sepa, lo unico que detectan para banearte es que hayas cambiado el disco duro. M$ no guarda una BBDD con informacion de cada xbox vendida, pero si que guarda informacion cuando conectas al live, si has conectado al live con un hd, y mas adelante te actualizas a uno mayor, este cambio lo detectarian y te banearan. Esto es lo que dice en lo que has puesto. ¿te estan dicendo que influye lo que tengas instalado?, no, pues eso.
y referente a la solucion que dan?
existe algun tuto?

Con esto quieres decir que si yo instalo esto por ejemplo : UXE+NKPatcher+UnleashX dejando el disco duro original yo podria seguir jugando al LIVE sin peligro de bano????
